Kirkland resident Steven McCanless, who spent time in a hospital bed in a coma last month, was formally charged by King County Prosecutors Thursday with second-degree rape of an Issaquah woman on May 23.

The man lapsed into the coma after being beaten by the woman’s husband and friend. McCanless has denied touching the 22-year-old woman.

Prosecutors have not decided whether to charge the two men for the assault.

The husband, wife and friends, including McCanless, had been drinking at an Issaquah bar when the woman began to feel ill. Her husband took her to a friend’s house to get some sleep and returned to the bar. McCanless realized that he was intoxicated, left the bar and returned to the house. The wife later told police that she awoke to find McCanless with his hand down her pants and touching her inappropriately.

The woman got up and went to the bathroom and called her friend from a cell phone and told him what had happened, said prosecutors.

When the group arrived at the house they found McCanless passed out on the couch, according to the charging papers. When the group woke up McCanless and confronted him with the inappropriate actions, he reportedly told them that the woman “wanted it,” said police.

The 30-year-old friend grabbed a rubber mallet and struck the man in the jaw. The husband then struck McCanless with a brick.

The husband told police that he did not mean to hurt McCanless so bad, according to charging documents.

McCanless suffered numerous injuries, including blood on the brain.

When officers arrived at the house, they observed McCanless laying on his side on the floor with a pool of blood near his face and hands. His head also had a large laceration. The officer noted that McCanless’ mouth was full of blood and had a notable deformity above the left eye and a misaligned jaw.

A witness told police that McCanless had supposedly raped the woman, and her husband and a friend got upset and confronted him, according to court documents. The husband later admitted to hitting the Kirkland resident with the brick and then threw the brick in the back yard. Police noted that the man was visibly shaken by the incident, according to charging documents. The brick was never found.

Another witness confirmed to police that McCanless was hit in the head with a brick by the husband.

McCanless told police that he had been drinking heavily that night but never touched the woman.

He has a lengthy criminal record, including second degree burglary, theft, criminal trespass, among others.

The state has requested $100,000 bail based on the likelihood that McCanless may commit a violent offense and due to the serious nature of the charges, according to court documents.
