Is it Legal to Use Delta 8 THC?

The short answer to this question is that it depends on how you interpret federal law. In 2018, the Farm Bill was signed into federal law, making a clear distinction between high-THC cannabis plants and hemp. Marijuana and products that contain high levels of delta 9 THC are illegal on a federal level, while products derived from hemp are permitted. That means that hemp plants are now a huge asset in the agricultural market.

The new regulations only mention delta 9 THC – delta 8 is not specifically mentioned in federal law. It’s generally derived from hemp plants and contains less than 0.3% of delta 9, so delta 8 THC is federally legal.

Some companies also use a method that converts CBD – a nonintoxicating legal cannabinoid – into delta 8 THC, which is also legal.

Despite its legality on a federal level, the states of Alaska, Arizona, Arkansas, Colorado, Delaware, Idaho, Iowa, Montana, and Utah have prohibited the sale of delta 8 THC.

Is it Safe to Use Delta 8 THC?

While there hasn’t been a lot of research on delta 8 THC specifically, the studies that have been conducted show no indication that its use produces any severe or life-threatening side effects, and there has never been a report of a fatal overdose.

In fact, most reports state that delta 8 has less risk factors of even minor side effects, such as anxiety and paranoia, compared to delta 9 THC. That being said, there are a few side effects to keep an eye on when using delta 8:

  • Dry mouth
  • Dry eyes
  • Difficulty concentrating
  • Nausea
  • Feelings of anxiety (in extremely rare cases)

Potential Risks of Vaping Delta 8 THC

The only legal forms of delta 8 THC are those that are extracted from hemp plants or converted from CBD. Hemp produces very little delta 8 THC naturally, so most companies opt for the synthetic process, which uses toxic components that can be harmful if they aren’t purified afterward.

You should be able to find the certificate of analysis from every batch on a company’s website.

All of the lab reports from third-party testing should include:

  • The product’s concentration of delta 8
  • The cannabinoid profile and terpene profile
  • Tests for bleaching agents, heavy metals, pesticides, and residual solvents

There is no reason for a legitimate company to hide their third-party test results – if a company doesn’t offer third-party lab reports, it’s probably one of these three reasons:

  • Their products did not pass third-party testing, either because they are not the promised potency, or they contain contaminants that are dangerous.
  • The company didn’t bother to send samples for testing in the first place, which means that they don’t care about making a quality product or their customer’s health.
  • The company refuses to send their samples for testing. This can be because there are a lot of brands out there that are owned by people who are just in it to make money and don’t know anything about the market or its standards.

Whatever the reason is, the lack of third-party lab reports on a product is a huge red flag, and you should take your business elsewhere.

2. Ingredients

As with any other product that you’re going to consume, you should check the ingredients list before you buy it. In the past, companies were adding a lot of harsh, harmful chemicals such as vitamin E acetate (which can cause lung damage) to their vape pens. While the market has improved significantly since then, there are still a lot of companies out there that don’t know (or don’t care) not to continue adding sub par or dangerous ingredients to their vape carts.

The only ingredients that you should see on the ingredients list in a delta 8 vape cartridge are the delta 8 THC distillate, other cannabinoids, terpenes, vegetable glycerin, propylene glycol, and other flavoring agents. If the company doesn’t offer a list of ingredients on their website, search for a different brand.

3. How the Product Is Made

Delta 8 THC is going to be the same no matter how it’s manufactured, but this does affect its legality. In states where marijuana products aren’t yet legal, the only federally approved products are made from hemp. It’s always best to confirm that your delta 8 carts have been derived from hemp if a marijuana derived product would be illegal where you live.

If you live in a state where recreational marijuana is legal, you might want to opt for a marijuana-derived delta 8 product because it takes less chemicals to produce a distillate from marijuana than it does from hemp.
